Wrongful Death

Wrongful death is a type of case for recovery of losses by children, parents, and certain other relatives for the loss of a person’s life, their future earnings and for certain other losses enumerated in Chapter 537 of the Missouri Code, the Missouri Wrongful Death Act. It is usually based upon allegations of negligence or intentional conduct resulting in the decedent’s death.

While death of a loved one is always painful, a preventable death caused by someone else’s misconduct is tragic. Wrongful death can be pleaded and proven in a variety of personal injury settings, including vehicular accidents, medical malpractice, construction accidents, and defective product claims, among others.
